The purpose of the article is to study the use of diagrams and their associated gestures in three diferent reals : mathematics and physics, painting and literature. An example will be ofered for each realm, borrowed from a specialist’s study. The reference book for mathematics and physics will be Gilles Châtelet’s book Les Enjeux du mobile. And the detailed diagrams will be Cauchy and Poisson's and Oresme's. The reference books for painting will be: Francis Bacon. Une logique de la sensation, (...) which is Gilles Deleuze’s theory of the diagram based on the painter Francis Bacon’s declarations to David Sylvester. As for Literature, after considering two statements by Paul Valéry on the conditions of literary creation, I shall defend my own thesis on the diagrammatic dimension of the literary text. The specifc gestures associated in each case to the use of diagrams will be analysed and compared. (shrink)

Women’s health activists laid the groundwork for passage of the law that created the U.S. Food and Drug Administration in 1906. The pharmaceutical and food industries fought regulatory reforms then and continue to do so now. We examine public health activism in the Progressive Era, the postwar era and the present day. The women’s health movement began in the 1960s, and criticized both the pharmaceutical industry and the medical establishment. In the 1990s, patient advocacy groups began accepting industry funds; thousands (...) of commercially-funded groups now dominate the advocacy landscape. As pharma funding became normalized, concerns arose regarding a) the lack of transparency and public accountability regarding funding, b) the distortion of groups’ agendas, and c) the ability of pharma-funded groups to dominate the discourse and override less well-resourced patient and health advocacy groups. Although industry-funded groups argue that funding allows them to provide useful services, the trade-off in health risks, exorbitant prices and distorted information is far too high. Sincerity is beside the point; patients and the industry have differing interests when it comes to drug safety and efficacy, drug information and drug prices. A growing resistance movement is asserting the values of its activist predecessors and opposing the prevailing culture of pharma-funded advocacy. (shrink)

And since we know that poets are marvelous craftsmen and craftswomen of language, we shall look for the cause to this effect in the poetic language and shall find it in the subtly modulated use (or non-use) of verbs in the poem, a different kind of use in each sentence, yet, converging to the same effect. And since verbs are also the main markers of time in language, the poem appears in the literal sense, as a verbal, a literary "still life." The sentence is a nominal clause: "An absolute/ patience."In the second sentence, "Trees stand/ up to their knees in/ fog," we find a static verb "to stand" and the personification of the trees clearly establishes that they might have moved, but they have not; they stand wrapped in the fog up to "their knees," i.e., between a quarter and a fifth of their trunks.In the third sentence, something moves: "The fog/ slowly flows/ uphill." But there is something contradictory in the fact of flowing up. Usually, rivers or brooks flow down. Flowing up, then, implies a difficulty to flow and consequently a slowing down of the rhythm of the flow which is here expressed by the adverb "slowly"; the adverb seems here all the more congenial to the flowing in that the two words are linked by a strong paronomastic effect: slowly flows, set in the two /s/, one at the beginning of slowly, the other at the end of flows: slowly flows.The fourth sentence is characterized by still another pattern: "White/ cobwebs. The grass/leaning where deer/have looked for apples." We now face the result of two past actions, actions that were performed before the scene that the poem invites us to contemplate was composed. In effect, the "white cobwebs" have been woven by the spiders at a previous moment, and they even had time to be colored in white by the drops of the humid fog. And "the grass leaning where deer have looked for apples" tells us that deer were here earlier, looking for food, but they no longer are, and what signals their former presence is a tenuous detail: the inclination of the grass, bent by their walking on it and searching through it, remaining bent for a little while after their passage. And to achieve her verbal strategy, Levertov even suppresses the auxiliary which might have been here. We read "the grass leaning" with a lonely present participle, and not "the grass is leaning."Another interesting grammatical event happens in the fifth sentence: "The woods/ from brook to where/ the top of the hill looks/ over the fog, send up/ not one bird." The first verb is a verb of perception ("to look") and not a verb of action. But the second verb is a verb of action ("to send up"), which is used in a quite unusual variety of the verbal negative form since instead of having the negative adverb attached to the verb (don't send up), we have an affirmative use of the verb ("send... A much‐debated series of articles in the New England Journal of Medicine in May 2015 labeled the pharmaceutical industry's critics “pharmascolds.” Having followed the debate for two decades, I count myself among the scolds. The weight of the evidence overwhelmingly supports the claim that pharmaceutical policy no longer serves the public interest; the central questions now are how this happened and what to do about it. I approached three of the most recent books on the industry with these questions in (...) mind. Deadly Medicine and Organized Crime (CRC Press, 2013), by Peter Gøtzsche, Bad Pharma (Faber & Faber, 2013), by Ben Goldacre, and Good Pharma (Palgrave MacMillan, 2015), by Donald Light and Antonio Maturo, all situate their critical assessments in high‐income countries globally, depicting the problem of pharmaceuticals as too many drugs approved with too little evidence, causing too many needless deaths, and prices spiraling to heights unimaginable just a decade ago. Light and Maturo, while no less critical of the status quo than Gøtzsche and Goldacre, take a different tack: they detail the success of an alternative model for pharmaceutical research, the Mario Negri Institute in Italy, citing it as proof positive that we can indeed defy capitalism's profit imperative. In the ambitious new book The Perils of Partnership: Industry Influence, Institutional Integrity, and Public Health, Jonathan Marks argues that far too much baggage is being piled on an old workhorse, conflict of interest. It’s an important concept, he asserts, but public‐sector actors can transgress their ethical obligations even when their relations with industry don’t create conflicts of interest. Yet policy‐makers have been immersed in public‐private partnerships for so long that they do not see the broader implications of such relationships. (...) Marks aims to move the discourse from reassuring terms like “engagement” and “inclusiveness” to concepts that capture the problematic side of the liaisons, like “webs of influence” and “agenda distortion.” Above all, he issues a challenge to public health policy‐makers: Ditch the comfortable hand‐in‐hand industry relationships, which prioritize efficacy over ethics, threatening both the public’s health and the integrity of public health institutions. Adopt instead a paradigm that is “mano a mano,” involving tension, struggle, and, at times, direct conflict with private industry. (shrink)

This article explores the relationships between legal proof and fundamental epistemic concepts such as knowledge and justification. A survey of the legal literature reveals a confusing array of seemingly inconsistent proposals and presuppositions regarding these relationships. This article makes two contributions. First, it reconciles a number of apparent inconsistencies and tensions in accounts of the epistemology of legal proof. Second, it argues that there is a deeper connection between knowledge and legal proof than is typically argued for or presupposed in (...) the legal literature. This connection is illustrated through a discussion of the Gettier problem in epistemology. It is argued that the gap or disconnect between truth and justification that undermines knowledge in Gettier cases also potentially undermines the success of legal verdicts. (shrink)

As Richard Bernstein has suggested, there is a very rich and interesting story to be told about how the classical pragmatists (Dewey, Peirce, and James) understood G. W. R Hegel, made use of Hegel, and ultimately distanced themselves from Hegel. That story cannot be told here. Indeed, the story is so rich and complicated that even its beginnings cannot be told here. But what can be provided, perhaps, is a limited, though hopefully illuminating, perspective on a few salient aspects of (...) the relationship between the classical pragmatists and Hegel. While the following reflections offer no definitive answers about this relationship, they might at least suggest some fruitful lines of enquiry for future discussion. (shrink)
